Aitihya.co.in — Seller Terms and Conditions Agreement


Parties:
Aitihya (hereafter referred to as “the Platform”, “we”, “us”)
Seller/Artisan (hereafter referred to as “Seller”, “you”)
This Agreement outlines the legally binding terms and conditions that govern
the relationship between Aitihya, an e-commerce platform dedicated to
promoting and selling traditional Bengali handicrafts and artisanal products,
and you, the Seller, who wishes to list, market, and sell products through the
platform www.aitihya.co.in.

  1. Eligibility and Registration
    Sellers must be:
    Indian residents or legal entities engaged in the creation of handmade or traditionally
    crafted products.
    Willing to submit valid identity verification documents (e.g., Aadhaar, PAN, Voter ID).
    Capable of providing product samples or detailed photographic evidence for initial
    screening.
    Not mandatorily required to have a GST number but encouraged to obtain one for future
    scalability.
  2. Verification and Approval Process
    Aitihya reserves the exclusive right to:
    Review and approve all seller applications based on authenticity, product quality, cultural
    relevance, and legal compliance.
    Reject applications without obligation to disclose the rationale.
    Conduct periodic re-evaluation of seller eligibility.
  3. Scope of Products Allowed
    Any legally approved product that can be sell on e commerce site and handcrafted or traditional items made using regional techniques are permitted. This
    includes but is not limited to:
    Textile art (e.g., handloom, block print, batik)
    Pottery and terracotta
    Woodwork and bamboo craft
    Dokra, jute, and metal crafts
    Folk paintings and hand-illustrated items
    Products that are mass-produced, imported, machine-manufactured, or infringing on third
    party rights are strictly prohibited.
  4. Intellectual Property and Originality
    Sellers must legally own all rights to the products listed.
    Any infringement claims resulting from copied designs, artworks, or trademarks will be the
    sole liability of the seller.
    Aitihya holds the right to remove any product suspected of being non-original without
    prior notice.
  5. Product Listings and Content Standards
    Each product must include:
    High-quality images from multiple angles.
    Clear and accurate titles, dimensions, material specifications, and usage guidelines.
    Care and maintenance instructions, if applicable.
    Aitihya may assist with product photography, editorial content, and image enhancement for
    consistency.
  6. Pricing and Commissions
    Sellers are expected to quote a base price (excluding platform margin).
    Aitihya will determine the final retail price after adding applicable commission, packaging
    cost, and marketing fees.
    Commission rates range between 10% to 25% based on product type, effort, and service
    level.
  7. Inventory and Availability
    Sellers are responsible for accurately updating product availability.
    In case of unavailability, sellers must inform Aitihya within 24 hours of order notification.
    Failure to fulfill repeated orders may lead to suspension.
  8. Packaging Requirements
    All products must be packed securely to withstand transit.
    Eco-friendly packaging is encouraged and may be provided under Aitihya branding.
    Improper packaging resulting in damage will attract penalties or deductions.
  9. Order Management
    Sellers will receive prompt notification of each order via email or dashboard.
    Orders must be ready for dispatch within 2-3 business days unless otherwise agreed.
    Unjustified delays may lead to order cancellation and loss of earnings.
  10. Logistics and Shipping
    Aitihya will coordinate courier pickup through designated partners.
    Sellers must be available during pickup slots and provide neatly labeled parcels.
    Any failure in pickup readiness may lead to delayed payments or order suspension.
  11. Shipping Costs and Damage Liability
    Shipping costs are borne by Aitihya unless specific campaigns dictate cost-sharing.
    If a product is returned due to damage caused by poor packaging, the seller will bear the
    loss.
  12. Return and Replacement Policy
    A 7-day return window is offered for damaged or misrepresented items.
    Sellers must cooperate in resolving return claims, including offering refunds,
    replacements, or clarifications.
    Repeated complaints may lead to warnings or delisting.
  13. Payments and Settlements
    Payments are processed within 7-10 business days post-delivery confirmation.
    Amount transferred = Sale price – (Commission + Taxes + Any penalties).
    Payments are made via NEFT/UPI/bank transfer.
  14. Taxation and TDS Compliance
    All earnings are subject to applicable Indian tax laws.
    TDS will be deducted at source if legally mandated. TDS certificates will be issued
    accordingly.
  15. Transparency and Communication
    Sellers must respond to communications from the Aitihya team within 48 hours.
    Miscommunication, lack of response, or fraudulent behavior may result in temporary
    suspension.
  16. Promotional Usage of Content
    Sellers grant Aitihya the right to use product photos, descriptions, artisan stories, and
    promotional media across platforms including social media, exhibitions, and print.
  17. Campaigns and Offers
    Aitihya may propose special campaigns, discounts, or flash sales.
    Seller participation is optional but encouraged for higher visibility.
    Discount margins will be pre-approved by the seller.
  18. Artisan Spotlights and Interviews
    Sellers may be invited for promotional interviews, spotlight stories, or behind-the-scenes
    content.
    Participation helps build artisan credibility and brand awareness.
  19. Exclusivity and Brand Collections
    Sellers are free to list elsewhere, but exclusive collections will be prioritized in visibility and
    promotion.
    Sellers can also collaborate on brand-only Aitihya editions.
  20. Packaging Support and Branding Kits
    Aitihya may provide printed labels, story tags, and thank-you cards to enhance customer
    experience.
  21. Customer Data Confidentiality
    Sellers will not have access to personal customer information.
    Aitihya will maintain customer communication and service on behalf of sellers.
  22. Performance Review and Quality Checks
    Sellers will be reviewed periodically on product quality, fulfillment timelines, and customer
    satisfaction.
    Aitihya reserves the right to pause listings failing to meet benchmarks.
  23. Temporary Deactivation Policy
    Sellers unable to accept orders due to personal or seasonal reasons must notify Aitihya
    for temporary suspension.
  24. Dispute Resolution
    All disputes regarding orders, returns, or settlements will be first addressed via internal
    mediation.
    If unresolved, legal jurisdiction will lie with courts in Kolkata, West Bengal.
  25. Fraudulent Activity and Termination
    Any fraudulent activity, such as counterfeit goods, misrepresentation, or unethical
    practices, will result in immediate account termination.
  26. Exit and Termination
    Either party may terminate the agreement with 7 days’ written notice.
    Pending payments, returns, and disputes will be settled post-termination.
  27. Data Protection and Privacy
    All seller data will be handled with strict confidentiality in compliance with applicable data
    protection laws.
  28. Updates to Terms
    Aitihya reserves the right to modify these terms at any time.
    Sellers will be notified via email or dashboard notifications.
  29. Acknowledgment of Terms
    Continued use of the platform implies acceptance of the most current terms.
  30. Final Agreement Declaration
    By signing or electronically accepting this agreement, the seller confirms they:
    Have read and understood the above terms.
    Agree to comply with all policies outlined herein.
    Will cooperate with the platform in maintaining a trustworthy and culturally rich
    marketplace.
